1. Introduction
Welcome to mPocket POS (the “App”). These Terms & Conditions (“Terms”) govern your access to and use of the App. By downloading, installing, accessing, or using mPocket POS, you agree to be bound by these Terms. If you do not agree, you must not use the App.
mPocket POS is a mobile point-of-sale application designed to help users manage sales, stock, customers, expenses, reports, and receipt printing using supported device features.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the App. By using mPocket POS, you represent and warrant that you meet this requirement.
3. License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or internal business use.
You agree that you will not:
- copy, modify, distribute, sell, lease, sublicense, or commercially exploit any part of the App except as permitted by law;
- reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except where expressly permitted by applicable law;
- use the App for unlawful, fraudulent, misleading, or harmful purposes;
- attempt to gain unauthorized access to the App, related systems, or connected services;
- interfere with the proper operation, security, or stability of the App.
4. Accounts and User Responsibilities
You are responsible for:
- providing accurate and up-to-date information where required;
- maintaining the confidentiality of your login credentials;
- all activity that occurs under your account, unless caused by our misconduct;
- ensuring that the business and customer data you enter is lawful, accurate, and used in compliance with applicable privacy and consumer laws;
- keeping your device secure and controlling access to it.
5. App Features and Device Connectivity
mPocket POS uses certain device features to provide core functionality. Depending on the features you use, this may include:
- Bluetooth: to scan for paired devices, and connect to supported Bluetooth printers for receipt and report printing;
- Internet / Network Access: for account-related features, password reset, and support requests;
- Camera (optional): if barcode or QR scanning features are available and used by you. This action is initiated by you.
You agree to use these features only for lawful and intended purposes. You must not use the App to attempt unauthorized access to devices, networks, printers, or services.
6. Business Records, Reports, and Backups
The App helps you create and manage business records such as stock, customer information, sales, expenses, receipts, and reports. Most of this information is stored locally on your device as part of the App’s normal functionality.
You are responsible for reviewing your records, maintaining appropriate backups where needed, and taking reasonable steps to prevent loss of data. Temporary files, such as generated PDF reports, may be created in the App’s cache to support export and sharing features.
7. User-Initiated Sharing and Third-Party Apps
The App may allow you to share reports or documents using third-party apps installed on your device, such as an email application. Any such sharing is initiated by you.
Once you choose to send content through a third-party app or service, your use of that third-party app or service is governed by its own terms and privacy practices, not ours.
8. Payments and Financial Transactions
mPocket POS helps you record and manage sales and related business transactions, but the App does not itself process card payments, bank transfers, mobile money payments, or other regulated payment services.
Any actual payment processing is handled by you or by separate third-party providers outside the App. We do not store your card numbers, bank account passwords, or similar payment credentials in the App.
9. Support and Communications
If you contact us through the App or through our support channels, you agree that we may use the information you provide, such as your name, email address, and message content, to respond to your request, provide support, and improve service operations.
10. Suspension and Termination
We may suspend, restrict, or terminate your access to the App, with or without notice, if:
- you violate these Terms;
- your use of the App creates legal risk, security risk, or harm to us, other users, or third parties;
- we are required to do so by law; or
- we discontinue the App or any related service.
You may stop using the App at any time by uninstalling it and, where applicable, requesting account deletion.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
We do not guarantee that the App will always be error-free, uninterrupted, secure, or compatible with every device, printer, or network configuration.
12. Limitation of Liability
To the maximum extent permitted by law, mPocket POS and its developers, owners, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, or data.
We are also not liable for losses arising from:
- device failure, printer failure, connectivity issues, or third-party service interruptions;
- your failure to back up, verify, or secure your data;
- unauthorized access caused by your failure to protect your device or credentials;
- your use of third-party apps or services to share, send, or process information.
Where liability cannot be excluded under applicable law, it will be limited to the minimum extent permitted by law.
13. Changes to the App and These Terms
We may modify, update, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time. When we do, we will update the “Last Updated” date above and may provide additional notice where appropriate.
Your continued use of the App after updated Terms become effective means you accept the revised Terms.
14. Governing Law
These Terms are governed by the laws applicable in your jurisdiction, subject to any mandatory consumer protection laws that may apply based on your place of residence or business.
